TERMS OF SERVICE

SECTION 1 - COMMISSION PROCESS

  • To secure your bespoke commission order, a 50% deposit must be paid when the order is placed. The deposit covers materials, initial design fee, fabrication of samples and the commission piece. The remaining payment is payable prior to shipping.

  • Vacarda Design will discuss the initial brief with the client to clarify the requirements. At this stage, Vacarda Design may ask for additional pictures and visuals that might help clarify the requirements.

  • The customer will receive initial design and composition sketches and up to three colour and texture samples to choose from, with the design being refined at each stage.

  • Once the customer is happy with all aspects of the design, the crafting process can begin. Vacarda Design will keep the client informed during the crafting process about the progress and the timescale and will share the visuals of the work for the customer’s approval.

  • Commission lead times vary and as each work is handcrafted and can take from several weeks to several months to complete.

  • Once the work is completed, the remaining balance must be paid. At this stage, Vacarda Design will calculate the shipment costs, which will be added to the final payment invoice.

  • The completed piece will be sent for framing and/or carefully packed and dispatched to the client along with the Certificate of Authenticity.

  • Vacarda Design will make its best effort to meet the customer’s desired delivery date. However, due to the nature of the crafting involved and the bespoke material requirements, we cannot guarantee the completion of the work by the customer’s desired date.

  • Any design and size customisation must be agreed before the work on the commissioned piece has commenced. For bespoke design orders, Vacarda Design will develop up to three design samples within the agreed commission fee. Any additional modifications to design and samples will incur an additional fee.

 

SECTION 2 - DISCLAIMER

  • All Vacarda Design works are hand-crafted using pigmented Italian plaster, as such imperfections and colour variation can occur. The hand-crafting process makes each piece unique, with no two pieces ever being the same.

  • Each artwork and bespoke murals are signed and dated by the artist and come with a printed certificate of authenticity. It includes the image of the artwork, the edition number and artwork details.


SECTION 3 - PAYMENT TERMS

 

  • To secure your bespoke commission order, a 50% deposit must be paid when the order is placed. The deposit covers materials, initial design fee, fabrication of samples and the commission piece. The remaining payment is payable prior to shipping.  The deposit is non-refundable (see Cancellation section).

  • All prices are quoted in UK Pound Sterling and payment must be made via BACS or PayPal. For quotes provided in other currencies, full payment must be made upon agreement of the commission to avoid any exchange rate changes at subsequent payments.


 

SECTION 4 - CHANGES TO REQUIREMENTS

 

  • If the customer changes the brief after the Terms of Commission have been signed, Vacarda Design can request additional time and payment for any subsequent changes, additions or variations to the commission piece. Vacarda Design reserves the right to refuse to carry out any changes, additions or variation which subsequently change the nature of the commission.

 

SECTION 5 - CANCELLATION

 

  • The customer has the right to terminate the order and claim back the deposit if the cancellation request is received within 7 days of placing the order. If Vacarda Design receives the cancellation request after 7 days since the order was placed, the deposit may not be refunded or may be only refunded partially, depending on the commission work progress t the time of cancellation.

 

  • If the order is terminated after the full payment is made, Vacarda Design will retain the entire sum to cover the production expenses.

 

  • The customer should forward all requests in writing to hello@vacardadesign.com.

 

SECTION 6 - GUARANTEE

 

  • During the first 12 months following delivery, Vacarda Design guarantees to repair or replace faulty parts. After this period, repairs and replacements will incur a charge. This warranty does not cover scratches or damage to the surface through misuse of the product or any damage caused by an during the installation.

 

 

SECTION 7 - DELIVERY POLICY

 

DELIVERY COSTS

  • The delivery costs on bespoke artworks and custom wall coverings will be assessed when quoting the commission, and will be subject to change - the true dimensions and weight of the item will not be known until the completion of the piece.

 

DUTY & TAXES

 

  • Orders outside of the EU may be subject to customs duty and/or tax at the point of entry into the destination country. The customer is responsible for paying any duty and tax as required by their country, and should therefore ensure they are aware of any applicable charges. Vacarda Design will not be responsible for paying such charges. Customers are not entitled to cancel an order on the basis of unforeseen duties or levies.

 

PACKING

  • We take great care in preparing your items for shipment to make sure they arrive to you safely. All finishes are wrapped with protective bubble wrap and packed in a sturdy cardboard tube. Original and bespoke artwork with be securely packed and shipped in a cardboard or crate, as required.

 

DELIVERY

  • Your item will be sent with tracked and signed courier service within one to two weeks of the order completion. Express delivery within and outside the UK is also available for some products for an additional charge.

  • Large scale pieces may require a professional art handling service. Such delivery may take several weeks, depending on your location.

  • Upon the delivery, the customer should inspect the package carefully and take note of any signs of damage before accepting the delivery. All damage evidence should be photographed and forwarded to Vacarda Design. You will need to keep the packaging until the claim is settled.

  • The customer should notify Vacarda Design immediately upon receiving their item if the order is not in accordance with the agreed commission requirements. If Vacarda Design is not notified within ten days of the delivery it will be conclusively presumed that the commissioned item is acceptable.

 

INSURANCE

  • During delivery, insurance is provided by Vacarda Design. Vacarda Design accepts no liability for damage or loss after delivery. Due to the value of commissions and original artwork, clients are recommended to ensure that they have adequate insurance for the item in its installed position.

 

SECTION 8 - RETURNS POLICY

  • Items that are personalised, bespoke or made-to-order to the customer’s specific requirements are non-refundable. If a fault is identified, Vacarda Design will endeavour to resolve the fault in-situ before agreeing to a replacement or accepting a return.

  • When receiving the order the customer is obliged to check the delivery condition in the presence of the courier. In the unlikely event of items arriving damaged from Vacarda Design studio, a replacement or repairs will be provided. Please photograph damaged items and packaging and email them to hello@vacardadesign.com. Notification must be made within two days of receipt of items. Please keep the packaging.

 

SECTION 9 – COPYWRITE

  • The commission piece is to be used solely for the purposes detailed above. Vacarda Design retains ownership of commissioned product design and all visual materials, including sketches, layouts and any other images and photography, that feature the product.

 

  • Vacarda Design artwork and bespoke surface finishes cannot be reproduced for any other images and could be subject to payment of a further fee, to be mutually agreed between Vacarda Design and the customer outside of this agreement. The customer must not sell or distribute copies of the work.

 

  • Vacarda Design owns the right to display the images of work in progress and that of the finished work on their social media, website, printed materials and other media for promotional purposes. Where the images are obtained from the customer, Vacarda Design will ask for the customer’s written consent to use the images for the studio’s promotion in social media.

 

  • The customer may post and share the visual imagery of the commission work on social media with copywrite credits given to Vacarda Design such as “Artwork by Tanya Vacarda, www.vacardadesign.com”. Any other use of the commission piece without Vacarda Designs written consent will be subject to a penalty fee.

 

SECTION 10 - ACT OF GOD

 

  • Vacarda Design cannot accept responsibility for any delay caused by an Act of God or any events beyond the studio’s control such as natural catastrophe, fire, equipment theft or failure, virus pandemic, the prolonging of amendments, approvals or payments by the customer, actions caused any third-party service providers, lockdown, strikes or closures. Should such an event happen, Vacarda Design will source materials from other suppliers but is unable to guarantee meeting agreed deadlines. Where possible, the customer will be notified immediately of such an event.

 

 

SECTION 11 - CORRESPONDENCE

  • Each party to give written notification on any subject to do with the commission detailed above. All correspondence should be directed to hello@vacardadesign.com quoting the invoice number.
